Who Pays? – Rideshare Insurance Explained.
If the Uber or Lyft driver was negligent Delaware requires Uber and Lyft rideshare vehicles to have $1,000,000 in bodily injury insurance coverage when carrying passengers. This means injured rideshare passengers can recover up to $1,000,000 for
- Pain and suffering
- Past present and future lost wages
- Loss of enjoyment of life
- Disfigurement
- Past, present, and future medical treatment
However, the amount of insurance coverage available to you as a rideshare injury victim depends on the driver’s status.
- The driver accepts the ride and is en-route to pick up passenger[s]. $1,000,000 in liability coverage of Uber or Lyft will apply.
- The driver is logged in and waiting to be matched with a rider. Delaware requires rideshare drivers to carry $50,000 in bodily injury coverage per person, $100,000 bodily injury per incident and $100,000 in uninsured and underinsured motorist. The driver’s insurance policy with a rideshare endorsement will pay. If the driver’s policy excludes this type of coverage, Uber or Lyft will cover the claim for $50,000 in bodily injury per person and $100,000 per incident.
- If the rideshare driver is not logged on or “off duty” their personal car insurance limits will apply.
If you were seriously injured in a rideshare accident, prior to going after the $1,000,000 in Uber or Lyft insurance coverage, per Delaware law, you must collect the driver’s personal policy first. In other words, the rideshare driver’s coverage is the primary, the Uber or Lyft policy is secondary. In Delaware, Uber or Lyft must disclose the app data for the 12 hours before and after the accident.
If another motorist on the road was negligent and caused your injuries, they would be the responsible party. The rideshare driver and Uber and rideshare company will also have underinsured or uninsured motorist if the other driver does not have enough coverage to cover your losses.
